I don't want to get into this too much as I personally (I'm not talking for OOTP here, just myself) don't really care if someone wants to sell or give away their license, but you don't have to agree to the license and you don't have to agree to buy it. If you don't like the terms of the agreement then don't buy it. It's pretty simple really and totally up to you. If you want to go back on your word and risk whatever the penalty might be then that's on you.
It's like a contract for anything. You want to buy or rent a house or a car? You have to agree to the terms of a contract. You don't like the terms presented to you then don't get it.
I think a lot of people don't really understand what a license really means. You don't own the game when you buy a license. Markus and co. own the game. You've only bought the right to use it under the terms of the agreement.
Maybe think of it like a lease. If you sign a lease do you now own that car or house? Of course not. Heck, you might not even be allowed to do certain things to it like paint it or alter it in some other way. You might not even be allowed to sub-lease it. You get to use it according to the terms of the contract and that's all.
Anyway, it's up to you, but if you think a license or a lease or whatever kind of similar contract entitles you to do whatever you want once you've paid for it regardless of what the agreement says then you couldn't be more wrong.
And by the way, when do you have to agree to the license? I'm pretty sure it's after you paid for it, but before you play it, so I really don't see any problem with buying it for someone else and then if they agree to the license only they get to make use of it. Maybe there's something in there about that too, but I doubt it.
