Preamble
This Collective Bargaining Agreement ("CBA" or "Agreement"), which is the product of bona fide, arm's length collective bargaining, entered into effective -------, --th, 20XX, by and between the National Baseball League, a joint venture organized as a not-for-profit unincorporated association ("NBL" or "League"), which is recognized as the sole and exclusive bargaining representative of the present and future Clubs of the NBL, and the National Baseball League Players' Association ("NBLPA" or "Association"), which is recognized as the sole and exclusive bargaining representative of present and future players in the NBL. The NBL and the NBLPA hereafter shall be referred to collectively as "the parties". This CBA, supersedes and replaces all prior CBAs and Memoranda of Understanding between the parties.

Article 1: Definitions
In this CBA, the following terms shall have the following meanings:
“Big League Contract” is the agreement between a player and a Club to play for them.
"Club" means a team in the NBL.
"Commissioner" means the Commissioner of the NBL.
"Free Agent (FA)" means a player who is currently on no club's payroll or minor league roster.
-"Restricted FA (RFA)" means a player who has not had Five years experience in the NBL who has reached the end of their current contract.
-"Unrestricted FA (UFA)" means a player who has Five years experience in the NBL who has reached the end of their current contract, OR a player whose contract was bought out by their club.
"Type I Player" is a player without Ten and Five Protection.
"Type II Player" is a player with partial Ten and Five Protection.
"Type III Player" is a player with full Ten and Five Protection.
"Minors" are each team's A, AA and AAA affiliates.
“Minor League Contract” means the player will not be counted against the payroll of the big league team, unless they are called up to the big leagues, at which point their MLC becomes a BLC worth $300,000 for one year. MLCs can only be one year in length.

article2: Recognition
The NBL recognizes the NBLPA as the exclusive bargaining representative of all present and future players employed as such in the League by the Clubs, but not including any other Club employees. The NBL and NBLPA agree that notwithstanding the foregoing, such players, acting individually or through certified agents, and Clubs may, on an individual basis, bargain with respect to and agree upon an individual salary over and above the minimum requirements established by this Agreement.

Article 3: Duration of Agreement
This CBA shall remain in full force until midnight on ---------,--th, 20XX (generally 10 years after the first one was signed). This agreement may be amended by approval of both parties. At that point, the duration will be in affect retroactive to the date signed and last until midnight on ---------,--th, 20XX.

Article 4: Management Rights and Rules
Section 1
Each Club, and where appropriate the League, in the exercise of its functions of management, shall in addition to its other inherent and legal rights to manage its business, including the direction and control of its team, have the right at any time and from time to time to determine when, where, how and under what circumstances it wishes to operate, suspend, discontinue, sell or move and to determine the manner and the rules by which its team shall play baseball. Nothing in this Article shall, however, authorize a Club or the League to violate any provision of this Agreement or of any Player Contract.
Section 2
Every Club has one owner who controls the team. However the owner may hire one co-owner/manager to help out with the team and they can hire representatives to go to CBA meetings if desired.
Section 3
Owners are allowed to use their inactive players’ money to upgrade the certain person.
Section 4
NBL will be simming three times a week. The sim days will be on Monday, Wednesday, and Friday. One one sim day, two weeks game time will be simmed.

Article 5: Strikes, Holdouts, No Discrimination and Practices
Section 1
Neither the NBLPA nor any player shall authorize, encourage or engage in any strike. Practices that may merit a strike will be attended to immediately at the off season, and appropriate clauses shall be added to the CBA to prevent such practices.
Section 2 - “Amanda Clause”
Neither the NBLPA, the NBL, nor any Club shall discriminate against or in favor of any player because of religion, race, color, national origin, sex, age, marital status, or membership or non-membership in or support of or non-support of any labor organization.
Section 3 - “Ford Clause”
No player who is a party to a Player Contract with a Club shall, during the term of such Player Contract (including any permissible option year that has been properly exercised by the Player or Club, as the case may be), enter into negotiations with another Club.
Section 4
No player may hold out from playing for their club unless their contract was violated (i.e., promised playing time not met), or they are unhappy with their salary and can prove they deserve more money by comparing their performance to another player who makes more money. The player must tell the NBLPA President and his Player Rep (i.e., the vice president). The President and the Rep will decide if the player has a case to hold out. If so, then they notify the GM of the Club that the player will not be performing. A buyout of the contract may be negotiated, or the contract must be restructured. In the event of contract violation, the contract must be paid in full and the player will be free to look for a new team.

Article 6: Player Rights
Section 1 - Contracts and Money
In order to play for a team, a player must enter into a contract with the Club. The contract’s basic purpose is to pay the player for services rendered. All contracts are to be drawn up with guaranteed money. A player is expected to play if they sign a contract. Holdouts are not to be taken lightly. Any player that gets clearance from the NBLPA to hold out will not get payment for the games they miss, and may not seek action to receive lost money by their actions.
Section 1(A)
The minimum monetary value a contract may have is $300,000 per year. All rookies who enter the league when assigned to a team through a draft will receive $300,000 one year contract for that year. At any point during the last year of a contract, an extension may be granted, which may be a Minor League Contract or a Big League Contract. Note that having a Big League Contract is no guarantee that the player will see big league time.
Section 1(B )
There is no maximum value for player salary.
Section 1©
Contracts may be restructured, but pay cuts are not allowed. At no point may a contract be restructured and the overall value of the contract decrease.
Section 1(D)
Members of the NBL and the NBLPA may earn money in other ways, such as radio shows, newspapers, etc.
Section 1(E)
Money may be spent on equipment, books, and training to increase the performance of the player. Money can only be spent during the off-season.
Section 1(F)
The only incentives allowed in a contract are non-monetary ones. These incentives include, but are not limited to: a waivable blanket No Trade Clause, a certain amount playing time, sole possession of a number, etc.
Section 1(G)
A buyout may be written into a contract. This is to be seen as the equivalent of the “option year.” If the club wishes to buyout a players contract before the end of the contract or the buyout point, they must pay at least 50% of the remaining value of the contract to the player. Only comes in a affect of Season 1 signed players.

Section 2- Free Agency
At the end of a Minor League Contract or a Big League Contract, that player becomes a Free Agent. There are two types of Free Agents: restricted and unrestricted. These follow from Type I players (rookies), Type II players (five years service), and Type III players (ten years service + five on one team).
Section 2(A)
Minor league contracts are be default one year long. They do not count against the payroll of the big league club unless the player is called up, at which point they make $300,000 against the team payroll. A person who has a MLC will be credited $300,000 as the minimum salary.
Section 2(B )
A Type I player (drafted rookie) has no say where they play. They are drafted by a team and expected to perform for them.
Section 2©
A Type II player has played for five years and are now considered a veteran. If they become a free agent before this time, they are not immediately released into the free agent pool. The team that they were last on retains the rights to that player. The controlling club has the right to match any offer that is made to the free agent and the player will continue his/her service with that club. If they become a free agent after this time, they are immediately released into the free agent pool and all teams are free to bid on them. A player who is not yet a Veteran who becomes a Free Agent is a “Restricted Free Agent (RFA).” A player who is a Veteran who becomes a Free Agent is an “Unrestricted Free Agent (UFA).”
Section 2(D)
A Type III player has played for ten years and at least five years on one team. Any Type III player has an AUTOMATIC waivable blanket No Trade Clause. Any Type III player who becomes a Free Agent is an UFA, and has a minimum salary of $600,000.
Section 2(E)
There is a 24 hour period between when a person is announced as a free agent and when they can be signed.
Section 2(F)
Inactive players who become FAs will have their business handled by the CPU. GMs are only allowed to enter one bid per 24 hour period to the inactive player. All bids are made in secret to the Commissioner by Personal Message or e-mail. A thread must be srated announcing that a bid was made. The value of the bid is not to be announced. The commissioner then takes the ONE contract offer with the highest value and makes the offer. If the player does not sign, then the commissioner announces in the thread that the offers were declined, and states the value of the largest contract. This continues once per day until the player is signed.
Section 2(G)
Players that belong to people who are General Managers or Managers cannot negotiate their own contracts with the sole attempt to get themselves on their own teams. Thus, all GM and Manager contracts will be handled by the CPU in the same fashion as inactive players.
Section 2(H)
Active players who become FAs will handle their own business. GMs must send a PM to the player who they are interested in. That player is expected to have a conversation with the GM about the contract and what they are looking for. A thread must be made the first time a GM makes contact with the player about signing a contract to alert the other GMs that someone is after the player. All bids are to be private between the player and the GM. Once an agreement has been reached, if the player is a RFA, they must report the value of the contract to the current team, who can either match it or not. If matched, the player remains on their current team. If not, the player is now signed to the new team.
Section 2(I)
Under no circumstances may a player who is under contract to one club speak with another club about a contract.

Section 3 - Trades
During most of the season and the off season players can be traded for each other, provided all teams involved can meet the payroll requirements of the trades.
Section 3(A)
The trading deadline of every season is August 1. No trades may be completed after then until the World Series has ended.
Section 3(B )
Any free agent that was signed cannot be traded until July 1.
Section 3©
Any Type II player (veteran), who is in a contract that is more than three years and not in the final year of their contract that is traded may request a trade at the end of the season. A serious effort by the Club’s GM must be made to trade the player. The NBLPA will be involved in any of these talks to assure that the correct procedures are being followed. The player does not necessarily get traded in all cases. Understandably, there just may not be a market.
Section 3(D)
Any player with a No Trade Clause has the right to reject any trade they are involved in.
Section 3(E) - Boss’ Clause
Any player who signs a contract under one GM may request a trade if that GM leaves his post. This trade request, however, is not to be taken as a requirement. The present GM is under no obligation to trade the player.
